Short answer: a motor that is genuinely rated at 500W, 750W or 1000W maximum continuous power does not normally become a 250W EAPC merely because an app or controller limits its output. UK EAPC rules use the motor’s maximum continuous rated power, which must not exceed 250W. A motor documented and marked as 250W may produce a higher short peak and still potentially comply, provided the bike also has working pedals and motor assistance cuts off at 15.5mph.
Why a software limiter is not the same as a 250W motor rating
A controller setting describes how the system is configured at that moment. A continuous rating describes the motor’s declared sustained capability under the applicable rating method. They are related, but they are not interchangeable.
The GOV.UK EAPC rules require the electric motor to have a continuous rated power output of no more than 250W. The Department for Transport’s more detailed EAPC information sheet uses the same test.
Therefore:
- A 750W continuous-rated motor with a 250W software mode is still documented as a 750W motor.
- A 250W continuous-rated motor that briefly peaks above 250W is not automatically a 500W or 750W continuous-rated motor.
- The rating must be supported by the manufacturer’s label and technical documentation, not invented after purchase.
Continuous power versus peak power
E-bike listings often mix three different numbers:

Ask the seller for the motor’s maximum continuous rated power, the motor label, the bike’s declaration of conformity and the assisted-speed specification. Do not rely only on a product title that says “250W mode”.
Can a 500W e-bike be road legal in the UK?
Not as an ordinary EAPC if 500W is its maximum continuous rated motor power. It would need to meet the relevant motor-vehicle approval, registration, insurance, licensing and helmet requirements before public-road use.
There is an important naming trap: some sellers advertise a compliant 250W continuous-rated system using a higher peak number. The evidence—not the largest marketing number—determines the position. If the motor plate and manufacturer documents say 250W continuous, investigate the rest of the EAPC specification rather than assuming the peak number decides the issue.
Can a 750W or 1000W bike be legal when restricted to 15.5mph?
A speed restriction deals with only one requirement. A normal EAPC must satisfy both the power and assistance-speed tests:
- maximum continuous rated motor power no higher than 250W; and
- electrical assistance stopping at 15.5mph (25km/h).
A 750W continuous-rated bike restricted to 15.5mph still fails the ordinary EAPC power test. Likewise, a 250W bike that assists above 15.5mph fails the speed test.
Does “road mode” make a high-power bike compliant?
A rider-selectable road mode is not strong evidence where the bike retains an accessible higher-power or higher-speed mode. The DfT information sheet states that cycles with an “off-road” mode capable of propulsion above 15.5mph do not, in its view, comply with the EAPC regulations.
A promise to leave the bike in one mode does not change what the complete vehicle can do. If a product was designed and rated as a high-power off-road model, treat it as a motor vehicle for public-road purposes unless the manufacturer or a competent approval authority provides evidence otherwise.
Does removing the throttle solve the power problem?

What must a normal road-legal EAPC show?
According to GOV.UK, the bike must display:
- the manufacturer;
- the continuous rated power output; and
- either the battery voltage or the maximum speed at which the motor can propel the cycle.
The pedals must be capable of propelling it, and the rider must be at least 14. Equivalent EAPC rules have applied in Northern Ireland since 2020; use nidirect’s current guidance for the NI position.
What are the options for a genuinely high-power bike?
Use it only where lawful on private land
Private-land use needs the landowner’s permission and does not include ordinary public roads, cycle lanes or public-access spaces merely because they look off-road.
Obtain the correct motor-vehicle approval
GOV.UK says a bike that does not meet the EAPC rules is classed as a motorcycle or moped. It must satisfy the appropriate approval and registration route and requires tax, insurance, a suitable driving licence and an approved motorcycle helmet. MSVA guidance explains one individual approval route.
Choose a documented 250W EAPC instead
For normal road and cycle-lane use, compare the UK road-legal e-bike collection and verify the individual product’s rating, assisted-speed cut-off and markings. Pre-purchase evidence checklist
- Photograph the motor’s rating plate.
- Ask for the maximum continuous rated power in writing.
- Confirm that motor assistance stops at 15.5mph in every rider-accessible mode.
- Confirm that the pedals and drivetrain can propel the bike.
- Check throttle capability and type approval, if applicable.
- Ask for the declaration of conformity and user instructions.
- Keep the invoice, specification and any approval number.

Frequently asked questions
Is a 750W e-bike legal in the UK if the speed is limited?
Not as an ordinary EAPC when 750W is the maximum continuous rated motor power. Limiting speed to 15.5mph satisfies only the assisted-speed requirement, not the 250W continuous-power requirement.
Can a 250W e-bike peak at more than 250W?
Potentially. The EAPC rule uses maximum continuous rated power rather than a momentary peak. Confirm that the manufacturer documents and marks the motor as no more than 250W continuous and that all other EAPC requirements are met.
Does limiting controller amps make a 1000W motor a 250W motor?
A controller limit can reduce delivered output, but it does not automatically change the motor manufacturer’s continuous rating. Obtain authoritative documentation for the finished vehicle rather than relying on a display setting.
Can police seize a high-power e-bike?
